1. Introduction

These Terms and Conditions (“Terms”) govern your use of the website absolutelasercutting.com.au (the “Website”) and the supply of laser cutting, fabrication, and related services (the “Services”) by Absolute Laser Cutting (“we”, “us”, “our”) to any person or business requesting a quote or placing an order with us (“you”, “your”, “Customer”).

By using our Website, submitting a quote request, uploading drawings or files, or placing an order with us, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website or Services.

2. Quotes

2.1 Quotes provided via our Website, by email, or verbally are estimates based on the information, drawings, and specifications you provide at the time, and are not binding until confirmed by us in writing.

2.2 Quotes are generally valid for 30 days from the date of issue unless otherwise stated, after which prices may be subject to change due to material costs, market conditions, or other factors.

2.3 We aim to provide quotes the same business day where files (such as DXF or DWG drawings) and complete specifications (material, thickness, quantity) are supplied; however, turnaround times are estimates only and not guaranteed.

2.4 Quoted prices do not include freight, delivery, secondary finishing (such as folding, welding, or powder coating), or any other service not expressly listed, unless stated otherwise.

2.5 We reserve the right to amend a quote if the drawings, specifications, quantities, or materials provided are found to be inaccurate, incomplete, or change after the quote is issued.

 

3. Orders and Acceptance

3.1 A binding order is formed when we accept your purchase order, deposit, or written confirmation following a quote, and we confirm the order in writing (including by email).

3.2 We reserve the right to refuse or cancel any order at our discretion, including where materials are unavailable, specifications are unworkable, or payment cannot be verified.

3.3 You are responsible for checking and confirming the accuracy of all drawings, quantities, materials, dimensions, and specifications provided to us before we commence production. We are not liable for errors arising from inaccurate or incomplete information provided by you.

 

4. Drawings, Files, and Customer Specifications

4.1 You warrant that any drawings, CAD files (e.g. DXF, DWG), sketches, or specifications submitted to us are accurate, complete, and that you have the necessary rights, licences, or permissions to provide them to us for the purpose of manufacturing the requested parts.

4.2 You retain ownership of any intellectual property in drawings or designs you provide to us. We will only use your drawings and files for the purpose of preparing quotes and manufacturing your order, and will treat them as confidential, except where disclosure to a subcontractor is reasonably necessary to fulfil your order.

4.3 We are not responsible for verifying the design integrity, fitness for purpose, or structural suitability of any drawing or design you provide. Our role is limited to cutting and/or fabricating parts in accordance with the specifications supplied.

4.4 We may retain copies of drawings and files for record-keeping, quality assurance, and to facilitate re-orders, unless you request otherwise in writing.

 

5. Pricing and Payment

5.1 All prices are quoted in Australian Dollars (AUD) and, unless stated otherwise, are exclusive of GST, which will be added where applicable.

5.2 Payment terms will be confirmed at the time of quote or order and may include full payment prior to production, a deposit with balance on completion, or approved account/credit terms for established customers.

5.3 For new customers or one-off orders, we may require payment in full, or a deposit, before commencing production.

5.4 If payment is not received in accordance with agreed terms, we reserve the right to suspend production, withhold delivery of completed parts, charge interest on overdue amounts at a reasonable commercial rate, and/or refer the debt for recovery, with associated costs payable by you.

5.5 Title in goods does not pass to you until payment has been received in full, even where goods have been delivered or dispatched.

 

6. Production, Tolerances, and Lead Times

6.1 We will use reasonable care and skill to manufacture parts in accordance with the specifications you provide, within standard industry tolerances for laser cutting of flat steel, stainless steel, aluminium, galvanised, and zincalume materials.

6.2 Minor variations in dimensions, edge finish, or material properties may occur due to the nature of the laser cutting process, material composition, and thickness, and are not considered defects unless they fall outside reasonable industry tolerances or your specified requirements.

6.3 Standard lead times are typically 3–4 business days from order confirmation, depending on workload, material availability, and complexity. Express or same-day services may be available at an additional cost, subject to capacity, and lead times quoted (including express turnaround) are estimates only and not guaranteed delivery dates.

6.4 We are not liable for delays caused by circumstances beyond our reasonable control, including but not limited to material supply issues, equipment failure, weather events, or delays caused by third-party transport providers (see Section 10 — Force Majeure).

 

7. Inspection and Acceptance of Goods

7.1 You should inspect all parts upon collection or delivery and notify us in writing of any defect, discrepancy, or issue within 7 days of receipt. Claims made after this period may not be accepted, except where required by law.

7.2 Where a genuine manufacturing defect is identified and reported within the timeframe above, we will, at our discretion, repair, re-cut, or provide a credit for the affected parts. This remedy does not extend to issues arising from inaccurate drawings or specifications provided by you, normal wear and tear, or modifications made after delivery.

 

8. Delivery and Risk

8.1 Delivery timeframes provided are estimates only. We dispatch parts across South East Queensland and beyond via our own transport or your nominated carrier, depending on the arrangement agreed at the time of order.

8.2 Risk in the goods passes to you upon collection from our premises, or upon dispatch to a third-party carrier or your nominated transport provider, whichever occurs first.

8.3 Where we arrange delivery on your behalf, we will take reasonable care in selecting a transport provider, but we are not liable for loss, theft, or damage to goods occurring during transit by a third-party carrier, except to the extent required by law.

 

9. Cancellations and Changes

9.1 Orders may be cancelled or amended only with our written agreement. Where production has already commenced or materials have been cut to your specifications, you may be liable for costs incurred up to the point of cancellation, including material, labour, and any restocking or cutting fees.

9.2 Custom-cut parts manufactured to your specific drawings or specifications cannot generally be returned or refunded once production has commenced, except where defective or not as ordered (see Section 7).

 

10. Force Majeure

We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay arises from circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather, power outages, equipment breakdown, supplier shortages, industrial action, or government restrictions.

 

11. Liability and Warranties

11.1 To the extent permitted by law, our liability for any loss or damage arising from the supply of Services is limited to the cost of re-supplying the affected Services or a refund of the amount paid for those Services, at our discretion.

11.2 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or other applicable law that cannot lawfully be excluded.

11.3 To the maximum extent permitted by law, we exclude all liability for indirect, consequential, or special loss or damage (including loss of profits, loss of business, or loss of opportunity) arising from or in connection with our Services or these Terms, except where such exclusion is not permitted by law.

11.4 We do not warrant that parts manufactured to your specifications will be fit for any particular purpose beyond what is expressly agreed in writing, and you are responsible for ensuring your design and specifications are suitable for your intended application.

 

12. Indemnity

You agree to indemnify and hold us harmless against any claim, loss, liability, or expense (including reasonable legal costs) arising from: (a) your breach of these Terms; (b) inaccurate, incomplete, or unlawful drawings, designs, or specifications provided by you; or (c) any infringement of third-party intellectual property rights arising from materials or designs you supply to us.

 

13. Website Use

13.1 You agree to use our Website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Website by any third party.

13.2 All content on our Website, including text, images, logos, and graphics, is owned by or licensed to us and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use this content without our prior written consent, except for your own personal, non-commercial reference.

13.3 We do not guarantee that the Website will be available, error-free, or secure at all times, and we are not liable for any loss arising from your inability to access or use the Website.

 

14. Privacy

Our collection and handling of personal information is governed by our Privacy Policy, which forms part of these Terms.

 

15. Confidentiality

Each party agrees to keep confidential any non-public business, technical, or design information disclosed by the other party in connection with a quote or order, and to use such information solely for the purpose of fulfilling the relevant order, except where disclosure is required by law.

If a dispute arises in connection with these Terms or our Services, both parties agree to first attempt to resolve the dispute in good faith through direct negotiation before pursuing any other legal remedy.

 

17. Variation

We may update or amend these Terms from time to time to reflect changes in our business practices, services, or legal requirements. The Terms in effect at the time you place an order will apply to that order. Continued use of our Website after changes are posted constitutes acceptance of the updated Terms.

 

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.

 

19. Governing Law

These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland in relation to any dispute arising from these Terms or your use of our Services or Website.
